The Department of Agrarian, Land and Ecological Law

In 2006 the Department of the agrarian, land and ecological law celebrated the 40-th anniversary of its existence. For a long time (1966-1986) the Department was headed by its founder - the doctor of law sciences, the professor Sereda Ivan Yemelyanovich. Further the Department was headed by the professors Stavisskiy P.R., Pavlovich Z.A. and Pogrebnoy A.A. who made essential contribution into its development. Since 2003 the Department is headed by the disciple and adherent of the professor Sereda I.Y. – the candidate of law sciences, the professor Karakash IIlya Ivanovich.

At present twelve permanent teachers work at the Department from which there is one professor, five Readers and seven assistants. The Department is structurally referred to the faculty of the civil and economical justice but in all educational subdivisions of the Academy it provides preparation of bachelors, specialists and masters by the four major subjects of educational plan by specialty “Jurisprudence”, “The agrarian law of the Ukraine”, “The land law of the Ukraine”, “The law of natural resources of the Ukraine” and “The ecological law of the Ukraine”. Of course in the modern period of development of jurisprudence of our country the land and ecological law have the priority among them. The mentioned disciplines are taught taking into account the formation of the market of land in the Ukraine and guarantee of ecological rights of citizens for healthy environment. The analogous content is put into teaching of other normative disciplines provided by the Department.  

With the purpose of scientific and methodical guarantee of educational process by the disciplines of the Department the professor and teacher staff is constantly working on preparation and publishing of educational and scientific literature. Thus, the professor Pogrebnoy A.A. took participation in the work on the text-book “The agrarian law of the Ukraine” (2000) on the base of collaboration in three editions of the text-book “Agrarian law of Russia” (1996, 1997, 1999). Under the editorship of the professor Pogrebnoy A.A. and the Reader Karakash I.I. an educational manual “The land law of the Ukraine” (2002) and the text-book “The land law of the Ukraine” (2003) were published. Under the guidance of the professor Karakash I.I. the author staff of the teachers of the Department prepared and published the course of lectures “The ecological law of the Ukraine” (2001) and the educational manual “The law of natural resources of the Ukraine” (2005).  

Under the guidance of the professor Pogrebnoy A.A. and the professor Karakash I.I. the professor and teacher staff of the Department has written the educational manuals : “The agrarian, land and ecological law of the Ukraine” (the general parts of the courses (2000) and “The agrarian, land and ecological law of the Ukraine”  (the special parts of the courses (2001). The publishing of the text-book “The ecological law of the Ukraine” under the editorship of the professor Karakash I.I. is planned for 2007/2008 academic year.   

The most remarkable is the activity of the teachers’ staff of the Department as compilers of collections of legislative acts and commentators of the valid legislation. In particular, they systematized and published such collections of the legislative acts as “The natural resources’ codes of the Ukraine” (2000). “The legislation of natural resources of the Ukraine” (2001), “The land legislation of the Ukraine (in 2 volumes, 2000), “The ecological legislation of the Ukraine” (in 2 volumes, 2001) those are in demand till present and used by the specialists. The teachers of the Department commented the essential part of the land code of the Ukraine (Kharkov – 2002, 2004 and 2005) and the land code of the Ukraine (Kiev – 2004) that became handbooks for lawyers – practitioners.

In the academic 2006-2007 years new special courses by the actual problems of the major educational disciplines and scientific specialties: “The acquisition and realization of the right for land in the conditions of formation of market relations in the Ukarine” (Karakash I.I.); “The law guarantee of management of lands in the Ukraine” (Glotova E.V., Gurevskiy V.K.); “The social-and-law problems of the ecology in the Ukraine” (Karakash I.I., Cheremnova A.I.).

The Department provides scientific research by the two major directions: improvement of the law regulation of the agrarian and land relations in the Ukraine and theoretical problems of realization of the property law for natural resources and protection of environment. The first direction is being developed by the Readers Gurevskiy V.K., Gavrish N.S. and Haritonova T.E., the assistants Bezhenar A.M. and Blumina S.O., the post-graduates Godovanyuk A.I. and Ivanova E.O., the second one is being developed by the Readers Glotova E.V., Karakash I.I. and Cheremnova A.I., the assistants Paliy N.I. and Chumachenko I.E., the post-graduates Babiy L.A. and Yureskul V.A.

For the period from 2000 till 2005 years the teachers of the Department prepared and published three monographic editions: Gurevskiy V.K. “The law of private property of the citizens of the Ukraine for the lands of agricultural purpose” (2000); Karakash I.I., Korotiy T.R. “The regional cooperation of the states in the sphere of protection of the sea environment” (2001); Karakash I.I. “The property law for land and the law of land’s use in the Ukraine” (2003), they also participated in the writing of collective monogram “The lands of agricultural purpose: the rights of citizens of the Ukraine” (2005). More than 50 scientific articles and reports, as well as methodical developments and recommendations are published annually by the results of the scientific research of the mentioned problems.

The kind traditions of preparation of pedagogical and scientific personnel are saved at the Department. At present the preparation of the eight post-graduates and six competitors by the specialty – the agrarian, land, natural-resources’ and ecological law is being hold at the Department. Besides the preparation of young scientific-and-pedagogical personnel is being hold not only for the work actually in the academy but for the provision of educational process in its isolated structural subdivisions (Dergach E.G. – Nikopol faculty, Derkach N.N. and Makarenko A. Y. – the education center of Krivoy Rog, Lokteva N.V. – The education center of Cherkassy, Sidor V.D. – the educational center of Chernovtsi).

The teachers, post-graduates and competitors of the Department are the participants of the series of the scientific-and-practical conferences and international symposiums that took place in different years in higher educational institutions of Kiev, Lvov, Odessa and Kharkov as well as in the countries of CIS (Russia, Belorussia, and Moldova). The articles and reports presented by them contain concrete offers by the improvement of the legislation and practice of its application. 

The series of offers by the development of new bills and under law normative acts by improvement of the law regulation of the agrarian, land, natural resources’ and ecological relations was introduced by the teachers of the Department to the Institute of the legislation of the Supreme Council of the Ukraine. Conceptual projects and separate offers by reformation of the agrarian and land relations were published in “Juridical bulletin” and in the collection of scientific works of the academy “Actual problems of the state and the law”. 

The teachers and post-graduates of the Department have made scientific reports in the magazines “The law of the Ukraine”, “The state and the law”, “The society, the state and the law” and “The prichernomorskiy ecological bulletin” and the other specialized periodical editions. The Department maintains active scientific and creative connections with the Departments of the same name of the Shevchenko T.G. Kiev national university, the Franko I. Lvov national university, the Yaroslav Mudriy national legal academy of the Ukraine, as well as the sectors and departments of the Koretskiy V.M. institute of the state and law of the national academy of sciences of the Ukraine.
